The Management Board of ENEA S.A. ("Company") hereby reports that on 9 August 2023, the Company received a decision from the Minister of Infrastructure on granting a permit for the erection and use of artificial islands, structures and devices in Polish maritime areas (exclusive economic zone) ("Decision") designated as area 60.E.4 for the construction of an offshore wind farm, applied for by Elektrownia Wiatrowa Baltica 5 sp. z o.o. ("Wind Power Plant").

The Company holds a 33.81% stake in the Wind Power Plant, while the remaining 66.19% stake is held by PGE Polska Grupa Energetyczna S.A. The capacity of the planned offshore wind farm to be constructed under the obtained permit will be approx. 0.56 GW.

The decision is not final. Within 14 days from the date of delivery of the Decision, the parties to the proceedings have the right to apply to the Minister of Infrastructure for reconsideration of the case. It is the Company's intention to report, by way of subsequent current reports, only the occurrence of circumstances that make it impossible to obtain such a Decision.
