Subject: Information on the effects of adoption of the production target for 2023 by a subsidiary, Lubelski Węgiel "Bogdanka" S.A., for members of the ENEA Group.

With reference to Current Report No. 57/2022, the Management Board of ENEA S.A. ["Company", "Issuer"] hereby represents that on 30 September 2022 it obtained information on the receipt, by ENEA Trading sp. z o.o. ["ENEA Trading"] from Lubelski Węgiel "Bogdanka" S.A. ["LWB"], of letters in which LWB notified the addressee of the continuation of the circumstances affecting the performance of its contracts with generation companies of the ENEA Group ["ENEA Group"] for the delivery of bituminous coal in 2023. According to the information provided in the said letters, LWB estimates that, in the worst-case scenario, the non-performance of the contracts entered into with ENEA Wytwarzanie, ENEA Elektrownia Połaniec and ENEA Ciepło will translate into the inability to deliver approx. 0.331 million tons of coal in 2023.
Detailed analyses of the impact of the situation on the necessity to purchase and the volume of bituminous coal required to be purchased by ENEA Group's generating companies from suppliers other than LWB and on the future results of the ENEA Group, including the amount of related provisions, if any, are still in progress.
