Subject: Execution of an annex to the surety agreement for ENEA Elektrownia Połaniec's liabilities

In reference to Current Report No. 48/2022 of 7 July 2022, the Management Board of ENEA S.A. ("Company", "Issuer") hereby reports that on 26 July 2022 it signed an annex to the surety agreement with Izba Rozliczeniowa Giełd Towarowych S.A. ("IRGiT") for the liabilities of its subsidiary, ENEA Elektrownia Połaniec S.A. ("Agreement"). The annex increases the surety amount by PLN 6,800,000,000, that is to PLN 10,800,000,000. The increase in the surety amount aims to optimize the portfolio of collateral contributed to IRGiT.

In connection with the execution of the annex, the Issuer will provide a notarized declaration of its voluntary submission to enforcement pursuant to Article 777(1)(5) of the Code of Civil Procedure up to the amount of the granted surety, that is up to PLN 10,800,000,000. IRGiT will be entitled to initiate legal action to issue an enforcement clause on the said notarized declaration until 30 September 2023.

All other terms of the Agreement remain unchanged.
