Subject: Decision regarding state aid received by the subsidiary ENEA Elektrownia Połaniec S.A.

Body of the report:

The Management Board of ENEA S.A. ("Issuer") hereby reports that on 9 August 2021 it received information that on the same day its subsidiary, ENEA Elektrownia Połaniec S.A. ("EEP"), received information about a decision made by the Minister of Climate and the Environment to completely discontinue the proceedings which the Issuer informed about in Current Report No. 19/2021.

During the administrative proceedings, EEP provided explanations supported by an opinion issued by an accredited unit which confirmed EEP's fulfillment of the conditions justifying its receipt of state aid.

EEP does not intend to exercise its right to request reconsideration of the case. Statements on the company's decision to refrain from exercising its right to file a request for reconsideration of the case will be sent promptly to the Minister of Climate and the Environment.

Having in mind the diverse and international nature of Enea SA's shareholding, and also the provisions of the Best Practices of WSE Listed Companies, Enea SA guarantees the availability of its website also in English. In case of any interpretation doubts and discrepancies between the Polish and English versions, the Polish version shall prevail.
