In relation to the current report No. 30/2014 of 3 September 2014 regarding conclusion of the Shareholder Agreement within the project of development and construction of the atomic power plant, the Board of ENEA S.A. ("Company") informs that on 8 October 2014 the Company received the information on the decision of the President of the Office for Competition and Consumer Protection ("President of OCCP") regarding the motion for performance of the concentration. After the conduct of the antimonopoly proceedings initiated on request of ENEA S.A., PGE Polska Grupa Energetyczna S.A., KGHM Polska Miedź S.A. and TAURON Polska Energia S.A. ("Applicants", "Parties") the President of OCCP issued an unconditional permit to perform the concentration, consisting in the establishment by Applicants of a common business entity under the name of PGE EJ1 Sp. z o.o. Obtaining the approval for concentration is a condition for the conclusion by the Parties of an agreement on purchase of shares in PGE EJ 1 Sp. z o.o., specified in the Shareholder Agreement.
