The Management Board of ENEA S.A. (the Issuer) announces that, on 25 June 2009, an annex (the Annex) to the agreement on the provision of electricity distribution services of 30 June 2007 was concluded between ENEA S.A. and ENEA Operator Sp. z o.o. (ENEA Operator). The Annex extends the term of validity of the Agreement to 31 December 2009 (by 6 months), and amends the hitherto existing value of the Agreement of 1,087,778,200 zlotys net, i.e. the planned value of electricity distribution services provided in the second half of 2009 by ENEA Operator to customers connected to the distribution grid of ENEA Operator who have concluded comprehensive agreements with the Issuer.

As a result of concluding the Annex, the total value of turnover between the Issuer and ENEA Operator on the basis of agreements concluded during the period from 26 March 2009 (i.e., from the publication date of current report No. 23/2009, in which the Issuer announced transactions with ENEA Operator of a value exceeding 10 per cent of the Issuer's equity) to the date of concluding the Annex is approximately 1,147,779,000 zlotys. From among the agreements concluded, the greatest turnover value will be carried out under the Agreement.

The total value of the above turnover between the Issuer and ENEA Operator exceeds 10 per cent of the equity of the Issuer.
