With reference to current report No. 29/2009 of 12 May 2009, the Management Board of ENEA S.A. announces that, given the failure to reach an agreement by 18 May 2009 in the matter of a pay increase, the Management Board of ENEA Operator Sp. z o.o. (the Company) gave notification yesterday to the Regional Labour Inspectorate in Poznan of the existence of a collective dispute with the following Trade Union operating in the Company:

-MZZ Pracowników Grupy Kapitałowej ENEA S.A.

Furthermore, the following Trade Unions operating within the Company have joined the collective dispute:

-MOZ Związku Zawodowego Inżynierów i Techników

-MZZ Pracowników Grupy Kapitałowej ENEA S.A. "Kadra"

The Trade Unions have decided to organise joint union representation in the collective dispute. The parties to the dispute have agreed that further negotiations will be conducted with the participation of a mediator, for the appointment of which the parties have turned to the Ministry of Labour and Social Policy.
