Acting pursuant to Clause 34 of the Regulation of the Minister of Finance on current and periodic information published by issuers of securities of 19 October 2005, the Management Board of ENEA S.A. (the "Issuer") announces that today it has received Resolution No. 44/2009 of 27 January 2009 of the Management Board of Giełda Papierów Wartościowych w Warszawie S.A. (the Warsaw Stock Exchange) ("GPW") on setting the final day of listing rights to series C common bearer shares of ENEA S.A. Pursuant to the aforementioned Resolution, the Management Board of GPW sets 29 January 2009 as the day of the final listing of 21,420,577 rights to series C common bearer shares of ENEA S.A. with a par value of PLN 1 each, marked by Krajowy Depozyt Papierów Wartościowych S.A. (the National Depository for Securities ) with the code "PLENEA000062".
The Issuer also announces that today it has received Resolution No. 45/2009 of 27 January 2009 of the Management Board of Giełda Papierów Wartościowych w Warszawie S.A. (“GPW") concerning the introduction to trading, on the main market of GPW, of series A and C common bearer shares of ENEA S.A. In accordance with the aforementioned Resolution, the Management Board of GPW resolves:
1. to introduce, on 30 January 2009, by the usual procedure, the following common bearer shares of ENEA S.A., with a par value of PLN 1 each, to trading on the main market:
a) 295,987,473 series A shares, marked by Krajowy Depozyt Papierów Wartościowych S.A. with the code "PLENEA000013",
b) 103,816,150 series C shares,
2. to list the shares of ENEA S.A. in the system of continuous trading under the short name "ENEA" and marked as "ENA".
The introduction to trading of 103,816,150 series C shares will take place on condition that Krajowy Depozyt Papierów Wartościowych S.A. registers the series C shares on 30 January 2009 and marks them with the code "PLNENEA000013".
